
A hearing was held in the court of ADJ I Anil Kumar Pancham on Tuesday on the demand for a survey by ASI of the closed basements S-1 and N-1 of Gyanvapi. The objection was filed by Anjuman Intejamia Masjid Committee on the application of Rakhi Singh, the plaintiff in the Maa Shringaar Gauri case. After hearing the arguments of both parties, the court fixed February 15 as the next date of hearing in the case.
Advocates Saurabh Tiwari and Anupam Dwivedi appeared in the court on behalf of Rakhi Singh. Said that it is necessary to survey the closed basements of the Gyanvapi complex with ASI. So, what the religious character of the premises on 15 August 1947 can be known.
In Gyanvapi, a survey of the S-1 basement on the south side and the N-1 basement on the north side could not be done. The entryway of both has been blocked with bricks and stones. The burden of the entire building is not on the bricks and stones of closed doors. In such a situation, a scientific survey of all the closed basements can be done without removing bricks and stones and without damaging the existing building.
At the same time, advocates Mumtaz Ahmed and Ekhlaq Ahmed, on behalf of the Anjuman Intejamia Masjid Committee, opposed the application for the ASI survey. Said that ASI and the Central Government have not been made parties in the original suit. Then, how can a survey be ordered? On this, it was said from the Hindu side that the Allahabad High Court has already decided. As per the provisions of the Code of Civil Procedure, it is not necessary to make ASI a party.
The parties will present the DGC criminal case on the demand of the case.
The plaintiff's lawyers completed the arguments in the case of registering an FIR for damaging the Shivling-like figure found during the survey by the Advocate Commissioner in Gyanvapi. On Wednesday, DGC will present the side of the criminal government in the court.
This application has been filed in court by Bajardiha resident Vivek Soni and Chitaipur resident Jaidhwaj Srivastava. Earlier, this application was rejected by the court of Special CJM Shikha Yadav after a hearing. After that, a revision was filed in the court of the District Judge. From there the application has been transferred for hearing in the court of ADJ Chaturdash.
Hearing of urgent case now on 15th February
The hearing of the urgent suit filed by Shailendra Yogiraj in the court of Civil Judge Senior Division was postponed. The next date for hearing has been fixed for February 15. According to the case, Shailendra Yogiraj has filed an urgent case regarding the worship and enjoyment of the Shivalinga-like figure found in Gyanvapi.
