CBSE Exams: Supreme Court's instructions to CBSE Controller of Examinations, reconsider students' complaints regarding the difference in marks

Supreme Court on CBSE Exams Result Assessment: The Supreme Court has directed the CBSE Controller of Examinations to reconsider the grievances of the students regarding the difference in marks and take an appropriate decision in the matter. A bench of Justices AM Khanwilkar and JB Pardiwala asked the CBSE Controller of Examinations to take the help of the technical team to understand the flow of algorithm/software making provision for different deduction of marks separately student-wise. The top court was hearing petitions of students who raised the issue of the difference in marks calculated by CBSE and the petitioner schools.

 

One of the petitions states that as per CBSE's Board Exam Evaluation Formula 30:30:30, the weightage of marks for class 10th, 11th, and 12th of a student are 106, 88, and 234 respectively i.e. totaling 428 marks which are were forwarded by the school, but the petitioner got only 364 marks in the result.

 

Thus, there was a difference of 64 marks between the petitioner school which uploaded the marks, and the result given by the respondent board. To this, the court said that the order passed by the Controller of Examinations on December 31, 2021, has neither taken care of this aspect nor made any arrangement to deal with it.

 

The top court said that because of this, we consider it appropriate to direct the CBSE Controller of Examinations to reconsider the above complaints of the petitioners and take an appropriate decision. They should take the help of a technical team to understand and explain the flow of algorithms and software which provides a different deduction of marks for different students wise.

 

The Supreme Court said that we cannot be treated as experts to express any opinion on this contentious issue in any way. All aspects may be considered by the Controller of Examinations on their merit and replied to within two weeks from today. With this, the court listed the matter for hearing on July 12.
