Lalit Modi Gets Major Relief in FEMA Case: Tribunal Quashes ED Penalty Over IPL 2009 South Africa Funds

Former Indian Premier League (IPL) Chairman Lalit Modi has secured a significant legal victory in the 15-year-old Foreign Exchange Management Act (FEMA) case linked to the hosting of IPL 2009 in South Africa.

The SAFIMA Appellate Tribunal has set aside the penalty imposed by the Enforcement Directorate (ED), ruling that there was insufficient evidence to hold Lalit Modi personally responsible for the alleged foreign exchange violations.

Why Was the FEMA Case Filed?

The case dates back to 2009, when the second season of the Indian Premier League was shifted from India to South Africa due to security concerns arising from the Lok Sabha elections.

The Enforcement Directorate alleged that the Board of Control for Cricket in India (BCCI) transferred nearly US$4.98 million (more than ₹243 crore) overseas for organizing the tournament without obtaining prior approval from the Reserve Bank of India (RBI).

Based on these allegations, the ED initiated proceedings under FEMA.

Tribunal Says Lalit Modi Was Not Responsible

In its 105-page judgment, the SAFIMA Appellate Tribunal observed that the Enforcement Directorate failed to establish Lalit Modi's direct responsibility for the financial transactions.
