
The decision of the court has come on Thursday on the petition filed by Kiran Singh Bisen regarding the Gyanvapi case of Varanasi. It has been said by the court that this petition is worth hearing. The order has been given by the Civil Judge Senior Division. The court has agreed to hear about the maintainability of the case. Now on December 2, there will be a hearing on whether the worship should be allowed or not.
In the hearing on Thursday (November 17) in the Gyanvapi case, the Civil Judge Senior Division Fast Track Court rejected the application of the Muslim side. The order was to come in the Gyanvapi case of Varanasi, in which the Civil Judge Senior Division Fast Track Court while rejecting the application of the Muslim side, has decided to continue the hearing on maintainability.
District Assistant Government Advocate Sulabh Prakash said that the court of Civil Judge (Senior Division) Fast Track Court, Mahendra Kumar Pandey has considered the suit filed by Kiran Singh as worthy of hearing. Prakash told that the advocates of the Hindu side argued that the deity has a fundamental right to get his property under the right to property. On this, the court rejected the objection of the Muslim side saying that the Place of Worship Act 1991 does not apply in this case. In such a situation, this case deserves to be heard.
Significantly, in this case, the plaintiff Kiran Singh had sought permission to bar the entry of Muslims into the Gyanvapi premises, hand over the premises to Hindus, and worship and enjoy the alleged Shivling. The Muslim side i.e. Anjuman Intezamia raised questions on the maintainability of the suit. The Muslim side had said that this matter comes under the Place of Worship Act 1991, so it should not be heard.
It may be noted that on the orders of the Civil Judge Senior Division court, in the videography survey of the Gyanvapi Shringar Gauri complex, a figure was recovered from the Vajukhana of Gyanvapi Masjid last May. The Hindu side claims that it is a Shivling, whereas the Muslim side, describing it as a fountain, said that it is common to find such fountains in Mughal-era buildings. Based on the figure found, the Hindu side had said that it is the deity of Adi Vishweshwar, therefore the entry of Muslims into the Gyanvapi campus should be stopped and that place should be handed over to the Hindus.
